01Operator and agreement

These Terms govern thrift.fit and its related services (the "Service"), operated by Best Price LC ("we", "us", or "our"), headquartered in Wyoming and registered to do business in California. By affirmatively accepting these Terms, you agree to them. If you do not agree, do not create an account or use features that require acceptance.

Section 12 requires binding arbitration of covered disputes, with the exceptions described there. Please read it before accepting.

Our Privacy Policy explains how we process personal information. Acknowledging it does not opt you into optional product analytics or marketing.

02What the Service does

thrift.fit is a personal shopping assistant that uses measurement comparisons and AI-assisted analysis to help you evaluate secondhand clothing listings from supported marketplaces, such as eBay. Recommendations of PASS, MARGINAL, or FAIL are estimates under our evaluation rules, not guarantees of fit, authenticity, safety, condition, availability, or value.

Best Price LC does not sell or ship the clothing shown. Purchases take place through the applicable marketplace between you and the seller. Verify measurements, photographs, price, shipping, availability, and return terms directly with the seller before buying.

03Eligibility and accounts

The Service is offered for personal use to residents of the United States who are at least 18 years old and have reached the age of majority where they live. You must provide accurate account information and protect your sign-in credentials and links. Tell us promptly if you believe your account has been used without authorization.

Do not use the Service for fraud, harassment, infringement, unauthorized access, bypassing access or usage controls, or interference with other users or systems. These restrictions do not limit activity protected by applicable law.

04Marketplaces and other providers

thrift.fit is independently operated and is not endorsed or sponsored by the marketplaces it supports, including eBay. Marketplace and other third-party names and materials belong to their respective owners. Connected services are governed by their own applicable terms and privacy practices.

We do not control sellers or their descriptions, shipping, payment processing, or return decisions. Use the marketplace's applicable support and dispute procedures for those transactions. If you connect a marketplace account, you authorize the connection for the permissions presented to you. You may revoke that authorization through the available account controls or the marketplace.

Third-party changes or outages may affect our features. Any changes to a paid service remain subject to the payment terms you accepted and applicable consumer law.

05AI-generated information

AI-generated descriptions, extracted measurements, condition assessments, and other outputs may be inaccurate, incomplete, outdated, or biased. We do not physically inspect items. The Service provides information to help you evaluate listings; you remain responsible for checking material facts before buying.

Illustrative examples and generated garment studies explain the product and are not live offers or evidence of a particular shopping outcome.

06Payments and subscriptions

Prices and benefits labeled as planned describe possible future offers. They do not create a subscription, authorize a charge, or promise an available feature. We will not begin charging for a new paid plan without presenting the applicable payment terms and obtaining your agreement.

If a paid plan is offered, the checkout terms must identify the price, currency, billing interval, renewal behavior, included usage, any separately authorized usage charges, applicable taxes, cancellation method and effective date, and refund policy. Those accepted terms govern that purchase, subject to mandatory consumer rights. We will provide required confirmations and notices.

Existing subscribers can use Settings → Billing to access billing management, even when new subscriptions are unavailable. Contact [email protected] if you cannot access cancellation or have a billing question.

Signing out, disconnecting a marketplace account, or using "Delete my saved data" does not cancel a subscription. Full account closure is a separate request, for which we coordinate subscription cancellation and any required record retention. Nothing here limits cancellation, refund, or other rights required by law.

07Content and intellectual property

You retain ownership of measurements, notes, photographs, and other content you submit. You give Best Price LC a non-exclusive permission to host, copy, process, and transmit it only as reasonably necessary to provide, secure, and maintain the Service, including through service providers described in the Privacy Policy. This does not transfer ownership or authorize use of your private content in public advertising or training of general-purpose AI models.

Submit content only if you have the necessary rights and permissions. Do not submit another person's private information without authority. The Service's code, design, and branding belong to Best Price LC or the respective licensors. You receive a limited, non-exclusive, non-transferable right to use the Service for its intended personal purpose while complying with these Terms. Third-party and open-source licenses retain their own effect.

08Disclaimers and consumer rights

To the extent permitted by applicable law, the Service is provided "as is" and "as available." We do not promise uninterrupted availability, error-free analysis, or particular shopping outcomes. To that extent, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Nothing in these Terms excludes a warranty, remedy, statutory right, or responsibility that cannot lawfully be excluded. Our AI and marketplace explanations do not excuse false statements by us or remove rights you have against us under applicable law.

09Limitation of liability

To the extent permitted by applicable law, Best Price LC is not liable for indirect, incidental, special, or consequential losses arising from the Service. To that extent, our total liability for claims arising from the Service will not exceed the greater of USD 100 or the amount you paid Best Price LC for the Service in the 12 months before the event giving rise to the claim.

These limits do not apply to fraud, willful misconduct, or any matter to the extent liability cannot lawfully be limited. They do not restrict mandatory consumer remedies.

10Responsibility for misuse

To the extent permitted by applicable law, you are responsible for third-party claims and reasonable losses resulting from your unlawful misuse of the Service, knowing infringement of another person's rights, or material breach of these Terms. This does not make you responsible for claims caused by our negligence, misconduct, or breach of law. Any settlement imposing a nonmonetary obligation on you requires your consent.

11Changes, suspension, and closure

We may change features or suspend access when reasonably necessary for security, misuse prevention, maintenance, legal requirements, or loss of a necessary provider. Where reasonably practicable, we will explain material restrictions and give notice. Paid-service changes remain subject to accepted payment terms and mandatory consumer rights.

You may stop using the Service at any time. Privacy controls let you export or remove supported saved data. Contact [email protected] for full account closure. Saved-data removal leaves your sign-in identity, legal acceptance record, and billing relationship intact.

12Binding arbitration and applicable law

You and Best Price LC agree to resolve disputes arising out of or relating to the Service or these Terms through binding arbitration, except as stated below. For claims subject to arbitration, both parties give up trial before a judge or jury. Judicial review of an award is limited.

The American Arbitration Association (AAA) will administer arbitration before one neutral arbitrator under its Consumer Arbitration Rules and applicable consumer fee schedule, including its Consumer Due Process Protocol. Either party may file a demand with AAA and give notice as those rules require. You may contact [email protected] to try to resolve a dispute informally; this is not a prerequisite to filing and does not shorten or suspend a legal deadline.

Arbitration will be based in California, subject to applicable law and AAA's consumer location protections. You may request a remote or documents-only proceeding as permitted by the rules. If an in-person hearing is needed, its location must be reasonably convenient to you; AAA or the arbitrator may select a location outside California when needed to satisfy those protections. We will not require travel to California contrary to those protections.

We will pay the arbitration fees allocated to the business by AAA's consumer rules and any additional amounts required by law. You will not be required to pay more than the consumer amount allowed by those rules or applicable law; available fee waivers remain available. Attorney fees and other recoverable costs are governed by applicable law. The arbitrator may award all remedies available under applicable law and must issue a reasoned written decision.

Either party may bring an eligible claim in small-claims court. This clause does not prevent complaints to government agencies or the exercise of rights that cannot lawfully be subject to mandatory arbitration. It does not waive public injunctive relief or any nonwaivable remedy. A request for public injunctive relief that cannot lawfully be arbitrated may be brought in a court with jurisdiction.

A court with jurisdiction decides disputes about the formation, validity, enforceability, or scope of this arbitration agreement, notwithstanding any delegation in AAA's rules. If AAA declines administration because we fail to comply with its requirements, you may proceed in court. If AAA is otherwise unavailable, the parties may agree on another consumer arbitration provider; if they cannot agree, either may proceed in court. An unenforceable provision is severed only to the extent permitted by law, without eliminating a remedy or requiring arbitration of a claim that cannot lawfully be arbitrated.

The Federal Arbitration Act governs this arbitration agreement. California substantive law governs these Terms, except that it does not deprive you of mandatory protections of the law where you reside. Courts with jurisdiction may enforce an award or hear matters excluded from arbitration, subject to applicable venue protections. This agreement survives account closure for covered disputes, but later amendments do not apply retroactively to an existing dispute.

13Updates to these Terms

We will identify the date of revised Terms and give reasonable advance notice of material changes through the Service or email, except where more immediate changes are required for legal or security reasons. We will obtain renewed agreement when required. Changes do not retroactively remove accrued rights.

If a provision is unenforceable, the remaining provisions continue to the extent permitted by law. A failure to enforce a provision is not a waiver. Provisions concerning ownership, accrued payment obligations, and disputes survive closure only to the extent their nature and applicable law require.
